Where this applies. The model WHS laws apply in the Commonwealth, NSW, Queensland, SA, Tasmania, the ACT, the NT and WA (WA with variations). Victoria has a different law (OHS Act 2004). Its periods are not shown here. Queensland: the register covers buildings built up to 31 December 1989 (other jurisdictions: 2003), and domestic premises are excluded.

  • Register need not be prepared if one already exists for the workplace (reg 425(4))
  • Does not apply to buildings constructed after 31 December 2003 with no identified or likely asbestos (reg 425(6))
  • Reg 425(6) exemption for post-2003 buildings with no asbestos
  • Applies while asbestos or ACM is identified at or likely to be present at the workplace
