How we research

Every entry can be traced back to the law it comes from, with the provision quoted and dated.

Where the entries come from

  • The official text. Commonwealth legislation comes from the Federal Register of Legislation. The state and territory limitation Acts come from each jurisdiction's official register.
  • Quoted, not paraphrased. Each record page quotes the provisions it relies on and links to the official text.
  • Dated. Each provision shows the date of the version of the law it was taken from.

The law, not advice on applying it

Each record page shows what the law says, and nothing more:

  • The terms: each provision's period, the event that starts it, and who it applies to.
  • Conditions and exceptions: what the provisions themselves say narrows or extends the requirement, and where the law is silent, such as when a period starts.
  • The law: the provision, quoted as published, with a link to the official text.

Working out which terms apply to your organisation, how to reconcile them, and how to put them into practice is interpretation. That is what ScheduleOne does.

Keeping it current

The law changes. Entries are updated when a change is identified, but there can be a delay, and a page may not reflect the latest amendment. Check the date shown on each provision and the official text.

The numbers

The register has 37 record pages, built from 102 provisions.

Not legal advice

WhenToDelete is general information about individual legal terms. It is not legal advice, it may not be complete or up to date, and it doesn't tell you whether a rule applies to you. Don't rely on it for decisions about your records. See the terms of use.

Who is behind it

WhenToDelete is a free public reference powered by ScheduleOne, which builds retention schedules from the same database. The reference shows individual legal terms. ScheduleOne does the next step: working out which terms apply to a particular business and turning them into one schedule.
